Business Terms of Service

1. Scope of Service & Architectural Isolation

1.1 Service Overview: The Platform provides commercial entities and independent business owners ("Business Partners") with a specialized partner account. This enables Business Partners to display a business pin on the platform map, publish short status announcements, upload store media, and access aggregated visibility metrics.

1.2 Feature Isolation: Business Accounts are strictly advertising and map visibility profiles. Business Accounts do not have access to consumer features, including but not limited to: member profile swiping, user browsing, community matching, or direct messaging with individual platform members.

1.3 Platform Integrity: Business Partners shall not attempt to bypass these architectural boundaries, reverse-engineer platform APIs, or harvest member data.

2. Eligibility & Commercial Verification

2.1 Authority & Legality: You represent and warrant that you are authorized to bind the business entity you represent and that your business operates in full compliance with the laws of the Kingdom of Morocco.

2.2 Verification Credentials: The Platform reserves the right to request proof of legal identity, including an ICE (Identifiant Commun de l'Entreprise), Register of Commerce (RC), or valid Auto-Entrepreneur documentation.

2.3 Credential Security: You are solely responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your business profile.

3. Partnership Application & Approval

3.1 Application-Based Onboarding: Joining the Platform as a Business Partner is application-based. You submit your store details and location, and the Platform reviews and approves each application before your place becomes visible to members on the map.

3.2 No Payment Required: There is no setup fee, monthly subscription, or payment required to apply for or maintain a partnership with the Platform.

3.3 Approval & Activation: Approved partners appear on the interactive map and can publish short status announcements and store media. The Platform may review or remove a partnership at any time if it violates these Terms or acts against the safety of members.

3.4 Partnership Status: A partnership may be active, under review, or paused. The Platform may pause or end a partnership without prior notice if a partner violates these Terms or poses a risk to platform members.

4. Content Standards, Copyright & Moderation

4.1 Public Store Photos & Customer Privacy (Droit à l'Image): Business Partners warrant that uploaded store photos do not contain recognizable faces of individual customers without their prior written consent, pursuant to Moroccan image privacy rights. Media must focus exclusively on storefronts, products, venue interiors, or authorized staff.

4.2 Intellectual Property Ownership: Business Partners retain ownership of uploaded logos, trademarks, and photos. You warrant that you own or possess all necessary licenses for all media uploaded, and that your content does not infringe upon third-party copyrights or trademarks.

4.3 Content Restrictions: Business status updates, photos, and descriptions must not contain: (a) Sexually explicit, violent, defamatory, or hateful content; (b) False, misleading, or deceptive advertising claims; (c) Unlicensed, restricted, or illegal goods and services under Moroccan law; (d) Direct contact details designed to bypass platform reporting or safety mechanisms.

4.4 Moderation & Immediate Removal: In compliance with Apple App Store Guideline 1.2 and Google Play UGC Safety Policies, the Platform reserves the sole right to review, edit, reject, or remove any store photo, status update, or business profile that violates these standards.

5. Analytics & Privacy Wall

5.1 Aggregated Metrics Only: The Business Dashboard provides high-level, aggregated metrics (e.g., total map pin impressions, profile clicks, broad age group distributions).

5.2 Strict Prohibition on User Identification: Pursuant to Moroccan Law 09-08 and global platform safety standards, Business Partners will NEVER receive access to individual user names, phone numbers, exact personal locations, chat logs, or verification photographs. Any attempt to re-identify individual users through aggregate data is a material breach of this Agreement and will result in immediate account termination and potential legal action.

6. Intellectual Property of the Platform

All platform software, interface designs, interactive map features, database structures, logos, and branding remain the exclusive intellectual property of the Platform. Business Partners receive a limited, revocable, non-exclusive license to use the business dashboard solely for authorized commercial visibility during active campaigns.

7. Disclaimer of Warranties & Limitation of Liability

7.1 No Foot Traffic Guarantees: The Platform provides advertising placement on an "as-is" basis and makes no guarantees regarding physical store foot traffic, customer conversion rates, or sales generated from map placement.

7.2 System Availability: The Platform is not liable for temporary service disruptions, maintenance downtime, or third-party store updates affecting app accessibility.

7.3 Indemnification: The Business Partner agrees to defend, indemnify, and hold harmless the Platform, its founder, and operators from any claims, liabilities, damages, or expenses (including legal expenses) arising from the business's physical operations, products sold, services provided at their venue, or breach of this Agreement.

8. Governing Law & Jurisdiction

This Agreement is governed by and construed in accordance with the laws of the Kingdom of Morocco. Any dispute, controversy, or claim arising out of or relating to this Agreement shall be submitted to the exclusive jurisdiction of the competent Commercial Courts of Morocco. The Platform further reserves the right to seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidential information.

9. Store Compliance & Store Policy Adherence

9.1 Business Partners acknowledge that the Platform is distributed through the Apple App Store and Google Play Store, and agree not to engage in any activity that would cause the Platform to violate the applicable Developer Terms of Service, App Store Review Guidelines, or Google Play Developer Policies.

9.2 Business Partners shall not distribute, promote, or facilitate the sale of goods or services through the Platform that are prohibited by Apple or Google store policies, including but not limited to illegal, regulated, or age-restricted items.

10. Termination for Cause

10.1 The Platform reserves the right to immediately suspend or permanently terminate any Business Account that violates these Terms, engages in fraudulent activity, uploads content that poses a safety risk to platform members, or impersonates a business entity without proper authorization.

10.2 Termination for cause may be enacted without prior notice. The Platform will notify the Business Partner of the termination decision via the email address associated with their account.
